Subject: Links Golf Course Maintenance – Fairway Oaks

Mr. Jack Mariano,

On behalf of the Fairway Oaks Homeowners Association, which represents all homeowners in Fairway Oaks, we would like to bring to your attention an ongoing nuisance with the now defunct Links Golf Course owned by Matt Lowman.

We have received numerous complaints from our homeowners about the unsightly condition of the Golf Course, which we all strongly believe has brought down the values of our properties.  There are homeless people living on hole 13. The Course has been operating as a Tree Farm.  Initially, there had been some maintenance done to the property, but since the change from Golf Course to Tree Farm, all mowings have stopped.

In an earlier letter of April 22, 2019, from Mr. Lowman to the Associations, he indicated that “all homeowners and Associations will be kept aware of any changes or conditions that affect the property”.  Unfortunately, this has not happened, and our efforts to contact Mr. Lowman for some dialogue regarding his responsibilities have all failed.

In our opinion we feel that he is blatantly trying to annoy us because we did not adhere to his ridiculous requests for financial assistance.  His property is not being maintained. he has rented out parts of his business, pro shop and golf cart barn, to others.  As far as we have been told, this is illegal.

We are all very disappointed and very frustrated with what Mr. Lowman is doing to our subdivision, and we are asking that you all look into this situation, that has clearly gone too far.  We would also like your input as to what other actions we may take, as an Association, on behalf of all our homeowners.

Good morning and thank you reaching out to me regarding your concerns about the Links Golf Course.  The Board has asked the County Attorney to bring back an Ordinance to help deal with issue of lack of maintenance of Golf Courses that no longer have play. This is among several other ordinances that the County Attorney is drafting. This particular ordinance was currently scheduled for the first part of 2020 but because of the COVID-19 pandemic it has obviously been pushed back a little.  Once this is completed it should clear up several concerns that you have.  It is my understanding that SWFWMD has been contacted to assure that the stormwater system continues to be maintained and functional.
